— a declaration that, by failing to adopt (all) the laws, regulations and administrative provisions necessary to comply with Directive 2003/98/EC (1) of the European Parliament and of the Council of 17 November 2003 on the re-use of public sector information or, in any event, by failing to communicate those provisions to the European Commission, the Portuguese Republic has failed to fulfil its obligations under Article 12 of that directive;
— an order that the Portuguese Republic should pay the costs.

The period prescribed for transposition of the directive into national law expired on 1 July 2005.
