On the 8th November 2006 the Information Commissioner, Republic of Slovenia, published the findings of the investigation undertaken following a complaint (021-54/2006/3) received from the Speleological Research Society Ljubljana versus Geodetska uprava Republika Slovenije (Surveying and Mapping Authority of the Republic of Slovenia).
Complaint Outline
The Speleological Research Society have appealed to the Information Commissioner following a request that was refused for the re-use geographic information for a not for profit use (data to be incorporated together with other data within an online caving cadastral information system) by the Surveying and Mapping Authority. The appeal was lodged under the Slovenian transposition of the European Union Re-use of PSI Directive.
The Information Commissioner confirms that the data and information requested is Public Sector Information which is produced by the Survey and Mapping Authority as part of their public task.
The case was upheld under Article 10 of the European PSI Directive 2003/98/EC (prohibition of discrimination between re-use applicants). In this case the commercial part of the Mapping Agency and the Speleological Research Society must be treated the same – no discrimination – a LEVEL PLAYING FIELD.

19 July 2006 Information Commissioner visits the National Mapping Agency in camera.
8th November 2006 Information Commissioner published the report and decision.
Outcome
The Information Commissioner has ordered the National Mapping Agency to supply the data to the Speleological Research Society within three days and for an invoice to be raised for the marginal costs involved in supplying the data requested.
The data to be supplied includes:
- Basic topographic maps 1:5.000 in 1: 10.000 – all layers;
- State topographic maps e 1:25.000 – all layers,
- Digital models of altitudes (25m metric mesh),
- Ortophoto 1:5000 – monochrome and colour.
