Sweden proposed Law on the re-use of the public administration: published

Sweden’s Finance Ministry (Finansdepartementet) has published a press release announcing the new proposed law that will correctly transpose the European Union Directive 2003/98/EC.

An approximate translation of the Swedish language press release states:

“Press Release February 25, 2010
Ministry of Finance
The Government is leaving the Council on Legislation for further use of public information

The Council on Legislation proposed a law on re-use of documents from the public sector. The Act governs, inter alia, conditions and charges that authorities apply for re-use of information. The law aims to promote the development of an information market by facilitating citizens' use of documents provided by authorities.

- I am glad that today we have taken a big step closer to a law for re-use of public information. The data collected or produced by the authorities can often be used by other actors in society and provide a basis for new services and businesses. For example, meteorological data used to develop weather services, spatial information can be used for various location-based services and the official statistics can be used to prove or disprove arguments in public debate, "said Local Government and Financial Markets Minister Mats Odell.

Public information from the Swedish authorities have long been used significantly for both commercial and non-profit purposes. Since the authorities have considerable information asset quality in electronic form, the potential for re-use much. It is the Government's opinion is important to improve conditions for the reuse of information from authorities in other areas of society, for both commercial and non-profit purposes.

The proposal will implement European Parliament and Council Directive 2003/98/EC of 17 November 2003 on re-using information from the public sector, the PSI Directive into Swedish law. The government will come back with proposals to encourage wider use of public information.

It is proposed that the Act comes into force on 1 July 2010.”

“The Council on Legislation proposed a law on re-using information from the public administration. The proposal will implement European Parliament and Council Directive 2003/98/EC of 17 November 2003 on re-using information from the public sector, the so-called PSI Directive into Swedish law.

The law aims to promote the development of an information market by facilitating the individual's use of documents provided by authorities on terms that may not be used to restrict competition. The law does not regulate the provision of documents or re-use is permitted. This is governed by other regulations, such as Freedom of the Press and publicity and the Secrecy Act (2009:400).

It is proposed that the Act comes into force on 1 July 2010.”
