An innovative and sustainable Norway

The Norwegian Ministry of Trade and Industry published a white paper titled: Et nyskapende og bærekraftig Norge (An innovative and sustainable Norway). The White Paper, Report No. 7 has been submitted to the Storting (2008–2009) where it was approved. Supporting the full Norwegian language report is a short English language summary version (24 pages).

Page 21 of the short report titled: Innovation in the public sector sets out what the Government will do which includes the statement:

“Establish favourable conditions for wealth creation based on sound solutions in the public sector and increased use of public data.”

Page 141 of the main report expands upon the above statement and refers to the European Union Direktiv 2003/98/EF:

Offentlige data kan gi private innovasjoner

Det produseres en økende mengde offentlige data med stadig høyere kvalitet og økt verdi for samfunnet. Slike data kan gi grunnlag for innovasjon i næringslivet. Blant annet kan geografiske data benyttes til navigasjonsutstyr i biler og meteorologiske data kan gi grunnlag for utvikling av forskjellige meteorologiske tjenester. For å sikre enklere tilgang til slike data har EU vedtatt et direktiv om viderebruk av informasjon fra offentlig sektor.14 Direktivet er gjennomført i norsk rett i den nye offentlighetsloven.15 Formålet er å legge til rette for økt verdiskaping og utvikling av nye private tjenester basert på offentlig informasjon. Det settes et øvre tak for prising av offentlig informasjon. Den nye offentlighetsloven går noe lenger ved å fastsette en regel om at adgangen til å ta fortjeneste kun skal benyttes i særlige tilfeller. Regjeringen vil systematisere erfaringene fra dette arbeidet. I enkelte utvalgte sektorer vil Fornyings- og administrasjonsdepartementet i samarbeid med Nærings- og handelsdepartementet og andre berørte departementer utrede innovasjonspotensialet i å tilgjengeliggjøre offentlige data. Blant de temaene som skal belyses er egnede forretningsmodeller og standarder. Regjeringen vil også videreføre norsk deltakelse i EU-programmer som skal gjøre digitalt innhold mer tilgjengelig for innbyggere og næringsliv i Europa. Allmennkringkastere, utdannings-, kultur- og forskningsinstitusjoner er unntatt fra direktivet. Regjeringen vil legge frem en egen stortingsmelding om digital tilgjengeliggjøring av den delen av kulturarven som er bevart i arkiv-, bibliotek- og museumssektoren.

Public data can provide private innovations

It produced an increasing amount of public data with ever-higher quality and greater value for society. Such data can provide the basis for innovation in business. Among other things, geographical data can be used for navigation in cars and meteorological data can provide the basis for the development of various meteorological services. In order to ensure easier access to such data, the European Union has adopted a Directive on the continued use of information from the public sector.(1) The Directive is implemented in Norwegian law in the new public law.(2) The purpose is to pave the way for increased value creation and development of new private services based on public information. It sets an upper limit for pricing of public information. The new public law goes further by the stipulation of a rule that the right to take profits can only be used in special cases. The Government will systematize the lessons learned from this work. In some selected sectors the Ministry of Government Administration in cooperation with the Ministry of Trade and Industry and other relevant ministries will study the potential of innovation from making public data available. Among the topics to be explored is the appropriate business models and standards. The government will also continue the Norwegian participation in EU programs that will make digital content more accessible to citizens and businesses in Europe. Members of the public broadcasters, educational, cultural and research institutions are exempt from the directive. The government will submit a separate White about digital availability of the part of the cultural heritage that is preserved in the archive, library and museum sector.
